OPINION
MARBLEY, District Judge:
Appellant LaDell DeAngelo Brown is a state prisoner seeking a petition for a writ of habeas corpus pursuant to 28 U.S.C. § 2254. A Sacramento County Superior Court jury convicted Brown in 2005 of first degree murder, attempted murder, and attempted robbery with enhancements for firearm use and prior convictions. He was sentenced to life without the possibility of parole plus an additional term of 74 years to life.
