MANTON, Circuit Judge.

By this indictment, the defendants below were charged with violation of section 37 of the United States-Criminal Code (Comp. St. § 10201). In substance, the charge is that they unlawfully, willfully, and knowingly conspired and agreed together and with other persons to commit an offense against the United States; that is, to violate the Act of December 17, 1914, as amended by sections 1006-1008 of the Revenue Act of 1918 (Comp. St. Ann. Supp. 1919, §§ 6287g, 62871, 6287r), in that they unlawfully sold and caused to be sold to one Milton Moffet 15 ounces of morphine, a…
