OPINION

By MERRICK, J.

This is a taxpayer’s action for injunctive relief, complaining that the defendants are expending tax money in the administration and execution of Ordinance 1316-A-43 of the City of Cleveland, which became effective February 9, 1944. plaintiff is a taxpayer of the city and brings the action as a class suit. Defendants are the City of Cleveland, its Com*354missioner of Assessments and Licenses and its Treasurer. The individuals are sued in their official capacities. In this opinion the parties will be referred to as the plaintiff and the City.
