THEIS, District Judge.
Currently pending before the court are defendant First Federal Savings and Loan Association of Hutchinson, Kansas’ (First Federal) motion for appointment of a receiver and plaintiff’s motion for attachment, temporary restraining order, and preliminary injunction. Plaintiff filed his complaint in April 1988, alleging fraud, breach of contract, and violation of the antitying provisions of the Home Owners Loan Act, 12 U.S.C. § 1464(q).
