This claim has been filed to recover pecuniary damages for the death of claimant’s intestate, Mark Q. Sutherland, who died on the 15th day of March, 1943, as the result of injuries sustained by him in the early morning of that day in an automobile accident caused, it is alleged herein, through the negligence of the State of New York, its officers and employees, in the construction, maintenance and safeguarding of that part of New York State Highway Route No. 9 located about one quarter of a mile south of Staatsburg, in the town of Hyde Park, county of Dutchess, New York, and at or near a *956point…
