Affirming.
The appellant (plaintiff below) is a stone mason by trade, and at the time of the sustaining of the injuries of which he complains in this suit he was in the employ of the appellee (defendant below), and engaged in assisting to construct a stone wall alongside of defendant’s track, between it and Elkhorn Fork of Tug Biver, near Northfolk in West Virginia.
