The appellants, together with several other persons, are sued as copartners, doing business under the name American Bank, to recover moneys which the plaintiff deposited with them as bankers at various times from the fifteenth day of September, 1870, until the ninth day of October, 1882. They do not deny that the partnership existed as alleged at the time the deposits, except the last two, aggregating $330, were made; nor do they deny that the deposits were made and received in the course of the business of the copartnership, but they contend that, for reasons…
