*395This is a proceeding by attachment, instituted by Mitchell against J. Huey Hughes and David Ashford Hughes, for the purpose of establishing the plaintiff’s claim, as a real estate broker, to commissions on the purchase price of land sold by the defendants directly to George H. Burwell, Jr.

The plaintiff broker and the purchaser lived in Clarke county, Virginia, while the vendors, the defendants, lived in Texas, and the entire contract between them is evidenced by telegrams and letters.
