Richey, Jr., appellee/peti-tioner and defendant below (“defendant”), challenges the decision of the Court of Appeals, 674 N.E.2d 1015 (Ind.Ct.App.1997), which reversed the trial court’s grant of summary judgment in favor of defendant.
