On December 30, 1988, Ernest Rutledge filed an action in Illinois state court under the Jones Act, 46 U.S.C. App. § 688, and general maritime law for personal injuries sustained in the scope of his employment aboard Scott Chotin, Inc.’s river towboat. He alleged two separate injuries the first occurring on or about May 1,1986, 1 and the second occurring on or about April 1, 1987.
