Petitioner-appellant John MaeKenzie was convicted after a jury trial in County Court, Nassau County, New York, of felony murder, manslaughter in the second degree, burglary in the second degree, and lesser offenses. In 1982, he was sentenced to concurrent terms of imprisonment, the longest of which was twenty-five years to life. The Appellate Division affirmed his conviction, People v. MacKenzie, 193 A.D.2d 700, 598 N.Y.S.2d 44 (N.Y.App.Div.1993), and he was denied leave to appeal to the Court of Appeals, People v. MacKenzie, 82 N.Y.2d 722, 602 N.Y.S.2d 819, 622 N.E.2d 320…
