Motion by plaintiff for an order confirming an award of arbitrators chosen by the parties hereto, pursuant to the provisions of article 84 of the Civil Practice Act, and directing judgment in accordance with the terms thereof.

Plaintiff moves to confirm an award of a board of arbitration appointed pursuant to an agreement entered into by the parties hereto. The motion is opposed by the defendants, upon the following grounds: (1) That the award is against the weight of evidence and contrary to the evidence; (2) that Adelbert N. Jones, one of the arbitrators, was incompetent to act because of partiality; (3) that plaintiff has abandoned the proceedings and waived his right to a confirmation of the award.
