Accompanying his motion for rehearing, defendant in error moves to dismiss the writ of error, because of lack of jurisdiction of this court, for that the certificate to the bill of exceptions does not certify the same to be true, nor is there a certificate that the bill of exceptions specifies all of the record material to a clear understanding of the errors complained of.
