By leave of this court granted on the last day of the June term, the People, on the relation of Frank Comerford, filed this petition for a writ of mandamus. The relator claimed to have been legally elected judge of the circuit court of Cook county on June 2, 1924, to fill a vacancy; that there is money due him as salary from Cook county; that August W. Miller, respondent, is clerk of the circuit court of Cook county, and it is his duty to put relator’s name on the pay-roll of the judges of the circuit court but that he refuses to do so.
