Defendants have moved to dismiss, or in the alternative for summary judgment on, the two counts in plaintiffs’ complaint.

Facts

On April 21, 1975, plaintiffs, who resided in McAllen, Texas (near Brownsville) and who owned and operated the Palmview Golf Motel and Travel Trailer Park, were telephoned by the night clerk at the motel in the early hours of the morning.
