This matter is before the Court on Defendant, Forest River Housing, Inc. d/b/a Sterling Homes’ (“Sterling” or “Defendant”), Motion For Partial Judgment on the Pleadings (Docket No. 83) filed by Sterling on June 9, 2006, pursuant to Federal Rules of Civil Procedure, Rule 12(c), against Plaintiffs, Patriot Homes, Inc. and Patriot Manufacturing, Inc.
