I. FACTS AND PROCEEDINGS

Following a September 29, 2003 automobile collision, plaintiff Augustine Fernandez (“Fernandez”), who is a New York domiciliary, commenced an action in New York Supreme Court, Bronx County, on January 13, 2004. Fernandez alleged damages in the amount of one million dollars, and named as defendants Hale Trailer Brake & Wheel (“Hale”), a foreign corporation with its principal place of business in Pennsylvania, and John Doe (“Doe”), the driver of the other vehicle involved in the collision, whose domicile is unknown.
