MEMORANDUM OF DECISION AND ORDER
KELLEHER, District Judge.
This is an action for personal injuries sustained by plaintiff William Murphy on December 4, 1973 on board defendant’s vessel, the M/V RAVI, which was upon the navigable waterways of the United States. Plaintiff filed this action in state court, alleging defendant was negligent under the provisions of the Longshoremen’s and Harbor Worker’s Compensation Act (Amended), 33 U.S.C. § 901 et seq.
