NEBEKER, Associate Judge:

This consolidated appeal presents for our determination the issue of whether 5 U.S.C. § 6324(a) (1976) 1 and its counterpart, D.C. Code 1973, § 4-525, 2 provide for compensation to members of the District uniformed services who are injured in the performance of duty where these injuries aggravate preexisting conditions not incurred in the performance of duty. The Police and Fire Departments have generally construed these provisions as not permitting benefits where officers aggravate non-duty injuries or conditions in the performance of duty.
