The defendant was indicted for disposing of property under lien, in violation of section 446 of the Criminal Code, which is as follows:

“Any person or persons who shall willfully and knowingly sell and convey any. real or personal property on which any lien exists without first giving notice of such lien to the .purchaser or purchasers of such real or personal property, shall be deemed guilty of a misdemeanor, and, on conviction thereof, shall be imprisoned for a term not less than ten days nor more than three years, and be fined…
