MEMORANDUM AND ORDER

SUSAN WEBBER WRIGHT, District Judge.

This case involves coverage under the Americans with Disabilities Act of 1990 (“the ADA”), 42 U.S.C. § 12101 et seq. Both sides have moved for summary judgment on whether the plaintiff, Anthony Wormley, was a disabled individual within the coverage of the ADA. The central issue in determining coverage is the definition of a “current drug user.” Persons engaging in the “current” illegal use of drugs are not “individuals with a disability” when the covered entity (in this case, the defendant-employer Arkla) acts on the basis of such use.…
