This is a rule for judgment for want of a sufficient affidavit of defense. Although the suit was brought against a municipality, an agreement was filed, signed by the Deputy Attorney-General of the Commonwealth and the Supervisors of the Township of Washington, wherein it was agreed “that the same be submitted for the opinion of the court upon a rule for judgment for want of a sufficient affidavit of defense, the affidavit of defense heretofore filed in the said suit to be regarded by the court in every respect as if said Township of Washington (Northampton County), Jacob O.…
