Defendant, James S. Benn, was duly appointed and qualified as a member of the Public Service Commission of Pennsylvania for a term of ten years, beginning July 1, 1920; he remained at his post without interference until July 30, 1925, and claims the right to continue in discharge of its duties; on the latter day, the Governor, without making any accusations whatsoever, notified the commissioner that, acting “by virtue of the authority vested in” the chief executive of the Commonwealth under section 4 of article VI of the Constitution, he removed him…
