MEMORANDUM AND ORDER
PLATT, District Judge.
Following the verdict of the jury in favor of the plaintiffs, Connie Francis Garzilli (“Connie Francis”) and her husband, Joseph Garzilli, for $2.5 million and $150,000, respectively, the defendant moved pursuant to Rule 50(b) of the Federal Rules of Civil Procedure to have the verdict and any judgment entered thereon set aside or, in the alternative, pursuant to Rule 59, for a new trial on the grounds that the verdict was against the weight of the evidence and excessive.
