Two cases presenting identical questions of law are consolidated for appeal. In both cases, the State asserts that the defendants have violated provisions of the Illinois Antitrust Act (Ill. Rev. Stat. 1979, ch. 38, par. 60 — 1 et seq.) (the Act), and the State seeks to impose civil fines pursuant to section 7(4) of the Act. In People ex rel. Fahner v. Climatemp, Inc., et al., the defendants are sheet metal contractors and the sheet metal workers’ union. In People ex rel. Fahner v. Borg, Inc., et al., the defendants are piping contractors.
