ROSEMARY M. COLLYER, District Judge.

Plaintiffs contracted with the Washington Metropolitan Area Transit Authority (‘WMATA”) to display an advertisement in four 43 x 62 inch dioramas on subway platforms. The ads state:

IN ANY WAR BETWEEN THE CIVILIZED MAN AND THE SAVAGE,

SUPPORT THE CIVILIZED MAN.

SUPPORT ISRAEL.

DEFEAT JIHAD.

The ads were to be displayed for approximately one month starting on September 24, 2012. Before that date, however, an American-made movie trailer that disgraced the Prophet Mohammad went viral on the Internet and caused large and dangerous anti-American demonstrations…
