TUTTLE, Circuit Judge.
This action was brought in a state court by Alvin J. Binzel, Jr., then doing business under the firm name of Kelite *135Products of Alabama, against Kelite Products, Inc., and R. C. Martin, and was duly removed by defendants to the United States District Court for the Northern District of Alabama, the requisite diversity of citizenship and amount in controversy being present.
