On March 7, 1967, a judgment of conviction 1 was entered against Casale Car Leasing, Inc. [Casale] for knowingly and, wilfully engaging in the business of a contract carrier by motor vehicle in interstate commerce without a permit issued by the Interstate Commerce Commission [Commission] in violation of sections 209(a) and 222(a) of the Interstate Commerce Act [Act], 49 U.S.C. §§ 309(a) and 322(a). 2 This appeal by Ca- sale presents a single narrow issue — did Judge Clarie submit the case to the jury-under proper instructions ?
