Appeal from the District; Court of'the Sixth Judicial District, Eureka County, The testimony in this case was, briefly, to the effect that Frank Connor, acting in concert with the officers of Eureka county, called at the defendant’s house about two o’clock A. M., knocked at the door and woke up the defendant, and told him that he (Connor) was very sick and must have some opium. Defendant at first refused to get up, but after some threats upon the part of Connor, he got up.

4ppellant was indicted, tried, and convicted of a felony for a violation of section 1 of the “act to regulate the sale or disposal of opium,” etc. (Stat. 1877, 69.) This section provides that “ it shall be unlawful for any person or per; sons, as principals or agents, to sell, give away, or otherwise dispose of any opium in this state, except druggists and apothecaries, and druggists and apothecaries shall sell it only on the prescription of legally practicing physicians.” The charging part of the indictment reads as follows: “The said defendant, Ah Chew, on the 30th…
