This is an appeal by plaintiff from an order setting aside, as to W. H. Sikes, a judgment taken at April Term of Cumberland on the ground of excusable neglect. The summons was duly served on the defendant Sikes and his codefendant Blue, on 14 July, 1913. The complaint was filed in apt time; no answer was filed by either of the defendants, and the cause was placed upon the calendar for trial at April Term, 1915, and being reached in its regular order on the calendar, the plaintiff introduced proper evidence to support the allegations of the complaint.
