THIS CAUSE comes before the Court upon Appellant, United States of Amer- ica’s, appeal from the Order of the Bankruptcy Court for the Southern District of Florida, 123 B.R. 662. The undersigned finds the United States Supreme Court’s holding in United States v. Whiting Pools, 462 U.S. 198, 103 S.Ct. 2309, 76 L.Ed.2d 515 (1983), to control the outcome of the instant case.
