Plaintiff, in her petition, alleges, substan tially, that the defendant is indebted to her for $3,000, interest and attorneys’ fees, on the annexed promissory note for a like amount executed by Mrs. Annie M. Keeney on August 1, 1914, less a credit of $700 paid by one Paul Kelly on October 6, 1927; that the note in question was secured by mortgage on certain real estate, which mortgage was reinseribed on December 18, 1923; that by a notarial act executed on April 12, 1927, defendant acquired by…
