This matter is before the Court upon Petitioner Weldon Stewart, Jr.’s pro se petition for a writ of habeas corpus pursu ant to 28 U.S.C. § 2254. 1 The record contains the report and recommendation (“R & R”) of a United States Magistrate Judge, which was made in accordance with 28 U.S.C. § 636(b)(1) and the local rules of this district.
