Appeal from a judgment of the Supreme Court (Lament, J.), rendered January 16, 1998 in Albany County, convicting defendant upon his plea of guilty of the crimes of criminal possession of a controlled substance in the second degree and criminal possession of a controlled substance in the third degree.
