Debtors filed a complaint for declaratory and injunctive relief and a motion for preliminary injunction on September 19, 2005, against the Commissioner of the New Jersey Department of Environmental Protection (“NJDEP”) and the Attorney General of the State of New Jersey in their official capacities. The New Jersey defendants (collectively herein “NJDEP”) moved to dismiss the complaint. Debtors filed an objection to the motion to dismiss.
