The plaintiff brought this action against the defendant, as executor of the last will of one Orley Hull, deceased, to compel said executor to perform an alleged parol agreement entered into between the plaintiff and said Hull, whereby he agreed to devise to her one-fourth of his estate at the time of his death. *427Said Orley Hull and one Mary Hull were husband and wife and plaintiff was their daughter.
