MEMORANDUM OPINION

KARON OWEN BOWDRE, District Judge.

This declaratory judgment action involves a question of insurance law and comes before the court on the Report and Recommendation from Magistrate Judge Armstrong. (Doc. 46). He recommended denying the motions for summary judgment filed by both sides because “a conflict of a material fact ... prevents granting a summary judgment to either party.” Both sides filed objections to the Report.
