FINDING AS TO MOTION TO DISMISS

H.F. WHITE, Bankruptcy Judge.

Defendants, Ralph J. Dalessio and William F. Stamm, have filed a Motion to Dismiss/Motion for Summary Judgment in opposition to the Trustee’s complaint. The court finds that their motion must be denied.

On January 10, 1984, Harold Corzin, the Trustee, filed a complaint against Messrs. Dalessio and Stamm, the debtor, and certain relatives of the debtor. The complaint lists four claims for relief against the defendants for: 1) breach of contract; 2) unjust enrichment; 3) turnover of property of the estate; and 4) fraudulent conveyance.…
