Plaintiff, Emanuel Y. Giuffre (“Giuffre”) has moved for leave to amend his complaint pursuant to Rule 15 of the Federal Rules of Civil Procedure. Defendant, Metropolitan Life Insurance Company (“Metropolitan”) opposes the motion for leave to amend and cross-moves to dismiss the amended claims pursuant to Rules 12(h) and 41(b) of the Federal Rules of Civil Procedure and to strike the jury demand.
