On January 7, 1974, plaintiff, Lavem Swords, President of Swords Engineering Company, filed a mechanic’s lien foreclosure suit against defendant, Donald J. Risser, and other defendants, for surveying services. All the other defendants were later dismissed and are not parties to this appeal.
The complaint alleged that defendant owned certain property on August 15, 1972. On that date, defendant entered into an oral contract with plaintiff for surveying services.
