Plaintiff 523 IP LLC (“Plaintiff’ or “523 IP”) brought this action, claiming that the “Patient Portal” product of Defendant Cu-reMD.Com (“Defendant” or “CureMD”) is infringing 523 IP’s patient-to-physician Internet messaging system, which was assigned Patent No. 7,702,523 (the “'523 Patent”). CureMD responds that its product does not infringe the '523 Patent and, further, that the Patent itself is invalid.
