MEMORANDUM OPINION AND ORDER
DAVIS, District Judge.
Defendants United State of America (“United States”) and the United States Department of Agriculture (“USDA”) (col lectively “Defendants”) have filed a Motion to Dismiss pursuant to Federal Rules of Civil Procedure 12(b)(1) and 12(b)(6). Having considered the parties’ submissions, argument of counsel at the July 17, 2003 hearing, and the applicable law, the Court finds that Defendant’s Motion to Dismiss should be GRANTED.
