Appeal from Cheboygan; Shepherd, J. Bill by Frank B. Sheldon against the Michigan Central Railroad Company and the Jackson, Lansing & Saginaw Railroad Company to restrain a trespass upon and to quiet title to certain land. Defendants filed an answer in the nature of a cross-bill to quiet title to said land. From a decree for complainant, defendants appeal.

It appears from the pleadings and proofs in this case that the complainant is the owner of lot 16 in, block 2 in R. Patterson’s first addition to the village (now city) of Cheboygan, county of Cheboygan, excepting, however, all that part of the above-described piece or parcel of land heretofore conveyed by Stanislaus Legault and wife to the Jackson, Lansing & Saginaw Railroad Company by deed dated the 18th day of September, 1880.
