ESHELMAN, J.,

This case came before the court on an appeal1 of an order of the Department of Transportation (hereinafter Department) suspending defendant’s operating privileges pursuant to Section 1532(b)(1) of the Vehicle Code, which mandates the suspension of the operating privileges of one who is convicted of driving while under the influence of alcohol or a controlled *220substance.2 A colloquy was conducted before this court in lieu of a hearing on June 28, 1983.
