Error to the Court of Civil Appeals, Fifth District, in an appeal from Dallas County" The actions were brought by Bonner and by Lefevre against Belsterling and others, and writ of error was obtained on affirmance by the Court of Civil Appeals of judgments rendered for defendants by the trial court. The opinion here rendered disposes of both cases, which involved the same questions.

The city of Dallas has a population exceeding ten thousand, and by special Act of the Thirtieth Legislature of Texas and by an amendment of its charter by the Thirty-First Legislature it was created a municipal corporation. Section 1 of article 5 of the charter provides for a board of education in this language:
