Action to recover for injuries sustained by the plaintiff, a minor, when struck by the auto of the defendant. There was a verdict for the plaintiff. The defendant appeals from an order denying his alternative motion for judgment or a new trial.
The plaintiff, a girl eight and one-half years old, was crossing the main highway in the city of Le Sueur on August 27, 1928, going from the east to the west, and was struck by an auto owned by the defendant and driven by one in his employ and received serious injuries.
