Affirming.
On the 24th day of August, 1891, appellant, the Deposit Bank of Owensboro, Ky., instituted a suit in the Daviess Circuit Court against Fuqua & Smith, a firm composed of J. A. Fuqua and Peter F. Smith, who were engaged in the tobacco business, on a note held by it against them for $18,-209.30. No attachment was taken out by the bank at the commencement of the suit. On the 28th day of August thereafter, appellee, Hattie Smith, also instituted a suit in the Daviess Circuit Court against the same parties on two notes which aggregated at the date of the…
