ORDER

THRASH, District Judge.

This is an action to recover benefits pursuant to a group disability insurance policy. At issue is the applicability of an exclusion for pre-existing conditions that result in disability within 12 months of the effective date of the policy. Both parties have moved for summary judgment. For *1298the reasons set forth below, the Court will deny the Plaintiffs Motion for Summary Judgment [Doe. 13] and grant the Defendant’s Motion for Summary Judgment [Doc. 14].
