This suit was instituted in the district court of Midland county by appellant to recover of the Houston, East West Texas Railway Company and the appellees, Houston Texas Central Railroad Company and Texas Pacific Railway Company, certain damages growing out of a shipment of cattle from Humble, Tex., to Monahans, Tex., over said lines of road. This is the second appeal of the case. See Texas Pacific Ry. Co. v. Good, 151 S.W. 617. On the former appeal a judgment in favor of the Houston, East West Texas Railway Company was affirmed.
