THIS MATTER comes before the Court on Defendant ASI New Mexico, LLC’s Motion for Summary Judgment on Plaintiffs’ Second Amended Complaint [Doc. 100] and Supporting Memorandum, filed March 3, 2014 (Doc. 182)(“MSJ”). The Court held a hearing on April 22, 2014.
